End User License Agreement (EULA) for MyAreaa

- Introduction
Welcome to MyAreaa! This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and MyAreaa ("Company," "we," "us," or "our") governing your use of the MyAreaa platform and its associated services ("Services"). By accessing or using the Services, you agree to be bound by this EULA. If you do not agree to this EULA, do not use the Services.
- Acceptance of Terms
By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by this EULA, our Privacy Policy, and any additional terms and policies referenced herein or available on the Services.
- Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet the eligibility requirements and comply with all applicable laws and regulations.
- License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use, subject to the terms and conditions set forth in this EULA.
- Account Registration
You may be required to create an account to access certain features of the Services. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- User Conduct
You agree not to use the Services for any unlawful or prohibited purpose, including but not limited to:
- Harass, abuse, or harm another person.
- Engaging in fraudulent or deceptive practices.
- Violating any financial laws, data protection laws, or consumer protection regulations.
- Impersonating another person or misrepresenting your identity.
- Uploading, posting, or distributing any illegal, harmful, or infringing content.
- Engage in any activity that could disrupt, damage, or interfere with the Services or servers.
- Engaging in financial transactions that violate applicable regulatory requirements.
- Features and Functionalities
The following new features and functionalities are now available on MyAreaa:
- Ability to block and report a user.
- Ability to accept or decline a chat request
- Ability to accept or reject MyPal request
- Ability to move a democratized community to an Admin Managed Community.
- Ability for an Admin to make other community members Admin also.
- Default Wallet creation in the Admin Managed Community.
- Activation of Wallet in the Admin Managed Community.
- Toggle for Visibility or Non-visibility of wallet for Admin Managed Community.
- 2/3 voting for withdrawal from the wallet in the Admin Managed Community.
- Simple majority voting for all approvals, including withdrawal from the wallet in the democratized Community.
- Ability to send/approve requests to join an Admin Managed Community.
- Withdrawal in democratized community is subject to being active in the last 2 weeks.
- Ability of an Admin to remove a user from the Admin Managed Community.
- Creation of bio for all users.
- Ability to make contributions to the wallet.
- Ability to make withdrawals from the wallet.
- Wallet for Democratized Community.
- 8. Financial Transactions and Compliance
- RaiseMe (ROSCAs)
MyAreaa provides a platform for users to engage in Rotating Savings and Credit Associations ("ROSCAs"). By using this feature, you acknowledge that:
- Participation is at your own risk, and MyAreaa does not manage or oversee ROSCA transactions.
- You must comply with all applicable financial regulations in your jurisdiction.
- MyAreaa disclaims liability for any disputes arising from ROSCA participation.
- Community Wallet and Aidlounge
- Users may voluntarily contribute funds to a Community Wallet or Aidlounge for community projects and donations.
- MyAreaa does not act as a financial institution, escrow service, or payment provider and is not responsible for lost or mismanaged funds.
- Users must ensure compliance with local laws regarding donations and financial contributions.
- 9. Privacy and Data Protection
Your privacy is important to us. By using the Services, you consent to our collection, use, and disclosure of your personal information as described in our Privacy Policy. We comply with:
- PIPEDA (Canada): Users have the right to access, correct, and delete their personal data.
- GDPR (Europe & Rest of the World): Users have the right to data portability, restriction of processing, and objection to automated decision-making.
- Cross-Border Transfers: MyAreaa implements safeguards to protect data when transferred across jurisdictions.
- Data Breach Notification: In the event of a breach, affected users will be notified in accordance with applicable laws.
- 10. Intellectual Property
All trademarks, trade names, logos, and content within the Services are owned by MyAreaa or their respective owners. You are not granted any rights to use this intellectual property without prior written consent.
- 11. Termination
We reserve the right to suspend or terminate your account if you violate this EULA, engage in fraudulent activities, or pose a risk to other users.
- 12. Disclaimers
- The Services are provided "as is" and "as available," without warranties of any kind.
- We do not warrant uninterrupted, error-free Services or immunity from cyber threats.
- Users assume all risks associated with financial transactions conducted on MyAreaa.
- 13. Limitation of Liability
To the fullest extent permitted by law, MyAreaa shall not be liable for:
- Any indirect, incidental, or consequential damages.
- Charges and Loss of funds due to third-party interactions, including ROSCAs, Community Wallet, or Aidlounge contributions.
- Unauthorized access to user accounts resulting from user negligence.
- 14. Indemnification
You agree to indemnify and hold MyAreaa harmless from any claims, liabilities, or damages arising from:
- Your use of the Services in violation of financial or regulatory laws.
- Third-party disputes related to financial transactions on the platform.
- Your failure to comply with data protection laws applicable in your jurisdiction.
- 15. Governing Law and Dispute Resolution
This EULA shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the ADR Institute of Canada, and the decision shall be final and enforceable.
- 16. Changes to this EULA
We may update this EULA periodically. If significant changes are made, we will notify users through the Services. Your continued use of MyAreaa after changes take effect constitutes acceptance of the revised terms.
